TERMS AND CONDITIONS

BOOKING

Emilia Reilly Photography does not incur a booking fee however if you are not able to come to your session I would like you co contact me as soon as possible as I may be able to book someone else in your place.

PACKAGE PRICE

The package price does not include any hidden fees, all prices are transparent as stated on Emilia Reilly Photography website. The client should read carefully the information and understand the fees and descriptions. In extreme circumstances such as illness or injury, the Client should get in contact as soon as possible to reschedule the appointment to another date (subject to availability).

PRICE OF PRODUCTS

Additional prints and products are available to purchase after your photography session and prices are in addition to the session fee.

FULFILMENT OF OBLIGATION 

Emilia Reilly Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil their obligations where failure arises as a result of an event or circumstances beyond their control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. The Client understands and accepts that the Photographic coverage will be as Emilia Reilly Photography's’ professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Clients wishes. In the unlikely event of total photographic failure or cancellation of the contract by Emilia Reilly Photography, liability shall be limited to a full refund of all monies paid.

LATENESS POLICY

The Client will be at Emilia Reilly Photography premises at the time of their booking and must consider traffic conditions or distance. Emilia Reilly Photography reserves the right to reduce the session time if possible if the Client arrives later than 15 minutes, or in case of short sessions (1 hour or less) to cancel the session.

ARTISTIC INPUT

Emilia Reilly Photography shall be entitled to use their judgment regarding the style and artistic input in the production of pictures. This includes but is not limited to poses, props and number of images taken. Due the willingness of subjects it may not be possible to capture all the pictures requested, or images to the Clients full expectations. In the event of uncooperative children at a session of any kind, for any reason, Emilia Reilly Photography may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions. Images are edited before presenting to the Client. Emilia Reilly Photography reserves the right to charge the Client for additional editing to cover time involved.

COPYRIGHT

The 1998 Copyright, Designs, and Patents Act assigns copyright to Emilia Reilly Photography. You may not copy the photographs taken under this contact, or allow copies to be made photographically, electronically, or by any other means.
The Client may not (either personally or via a third party) alter or manipulate a picture by any means.

FORCE MAJEURE

In the unlikely event of total photographic failure, injury or sickness beyond Emilia Reilly Photography's control, their liability shall be a limited to a full refund of all monies paid.

USE OF PICTURES

Emilia Reilly Photography retains the right in all cases to use any pictures for the purposes of displays, advertising, portfolio, publication or promotion of its work.

PRINTED PRODUCTS AND WALL ART

All notifications regarding the poor quality of a product / wall art must be made in writing within 7 days of receipt otherwise Emilia Reilly Photography will not be liable for any discrepancy.

If you choose to order digital files and have them printed at a place of your choice Emilia Reilly Photography cannot be held responsible for the quality of the printing or the quality of the products. All digital files are provided as high resolution and it is the Clients responsibility to source a printing service that can provide prints using high
resolution files.

UNEDITED IMAGES

The client does not receive any unedited images as this is classed unfinished work. The client will receive only edited, finished images as stated in the chosen package.

SELECTION TIME

The Client has 7 days to select the photos according to the instructions sent via email after the session.

COOLING OFF PERIOD

All portraits, prints, albums, frames are non-refundable. Orders are made to the Clients personal specification, (i.e. image number, print size, frame style etc.) the Client does not have the right to a cooling off period. By placing an order with Emilia Reilly Photography you are committing to buy the ordered products.

Your booking of your session signifies acceptance of these terms and conditions as a legally binding contract, unless otherwise objected to explicitly and in writing, prior to accepting my service. No variation of this contract shall be recognised unless explicitly agreed to in writing.

Any booking or payment made to me indicates that you have read, understood and agreed to all the terms and conditions as set out in this document, in its entirety. If this contract has to be enforced, you agree to mediation instead of court proceedings.
